Should I pay up for the error made by dealer?

situation is this..

in black/white, the loan settlement amount is $xxk. i made the final payment to the dealer who will settle it with the bank on my behalf.

we all thought all's find and dandy, i handed over my car and took over the new.

signed the paperwork (taken over), LTA transfer and stuff done.

few days later, dealer called and say there's a mistake.. i need to pay him another few hundred dollars.cos of miscalculation in the bank's loan settlement amount for my old car.

i called the bank, and realized the issue.. they told me my final settlement amt (which tallies with the paperwork done with dealer). what they didn't tell (only did after i further enquired) is that that amt is actually AFTER my latest giro deduction, which means the settlement at the point of enquiry should be higher.

now.. the dealer realized the mistake and asked me to make up the difference.

if i pay up the difference, all the paperwork will need to be signed again.. and who knows what others will come up.

should i do it? black/white paper all indicated the lesser amount.

would i get sued by the dealer for not entertaining him?

It is an honest mistake. Not like anyone is out to cheat anyone.

If you insist on the black and white - which you seem to lean towards, there is nothing wrong technically.

Of course, there is always karma...

I would pay personally because it was the bank's fault and there's no recourse for it. The dealer should be pretty new because a seasoned dealer would have asked for black and white from them bank and the amount would have been stated clearly. Of course if you decide to pay eventually, do ask for black and white. While I don't want to take advantage of people, I hope I'm not taken advantage of too. Cheers!

thanks youngman for your reply.. that's exactly what bothering me.. on b/w they made the mistake and i am not obligated. but i felt i should top up..

cos for this one, i am able to verify the amount, but on the other hand, i would also not know if they will come out with some other pattern to make me pay more money when the deal is supposed to be closed.

agree with barney.

the bank is the key agency to state the exact amount, which can change a couple of hundreds over a day or two.

on this, i think the bank should have been clearer with the amount, and give an exact amount to the dealer to you. the dealer in this case, is more like a middle person. of course, there has been cases where dealers sit on their payment until interest has incurred and they (dealers) expect us to pay the difference - to this, can foxtrot them.

otherwise, i would have paid the difference but not before giving them a mouthful.
