Seeking advice - Car aint well repair after accident

Hi all,
I'm new to this forum.
Would like to write in to seek some advices.
4 months back, i met with an accident where i was rear ended, with my left rear being damaged. i drove a e250 cabriolet and i send my car to the workshop to repair. the workshop will help with me the repair claims, as well as got a law firm to help me with personal injuries claims.

After i've got back my car, i notice that on e right rear of my soft top, some parts of the cloth got dislodged. i informed my garage, who tried to fixed the issue, but long story short, after a few tries over a period of two months, it wasn't fixed. 
the last time i visited him, he told me that he spoke to other garage and that this was a norm for my vehicle when such models all have this issue and water will not sipped in.
i told him that was not the case and even when i have e accident, the soft top was well intact, it was only when i came and take e car, then i saw the cloth dislodged.

i told him no matter what it has to be fixed and he told me that he need to check if that can be claim from the other party insurance!?!?
honestly speaking, i felt that he is trying to pull a fast one from me.

Would like to check if any one knows whether i can stop the law firm from letting him have the repair money since he did not do a proper job for me and that my car is not fully repaired at all
