Help - Lemon Law and Warranty , Transmission gear

I bought a E230 and was assured of lemon law coverage for 6 months. I also request the dealer to do a STA check and car servicing . The check came with a list of defects highlights and i was assured that the defects were rectified with a warranty of 6 months as well. Since then , I had been having issues right from the second week after car collection. After much chasing, I was asked to bring the car to their workshop and on the second visit, , the workshop acknowledge there was a transmission gear problem. 3,days later, the car broke down, all within 5 months of getting the car.

The dealer claim that it is wear and tear, and want me to pay about 60% of the bill for repair . I suspect they never rectify the defects in the first place. The car is sitting there for a month already.

Can anyone advise on coverage of warranty ? Will C&C or any dealer simply say it is wear and tear , even if within 6 month warranty period ?

How to ensure portion they group under wear and tear is reasonable out of the total bill ?

Any one can share how much would replacing transmission gear in outside workshop costs ?

If a car was delivered to me in good condition, is it likely for transmission gear to breakdown within 5 months ? (My usage is very low )

Go to another workshop to get a quote then ssk the dealer to foot the bill. If he refused, try to nego to share part of the bill else go to small claims court. No point going back to the dealer workshop. Tell him after this repair u will not go back to them if there are any more issue. Check out our aite sponsor workshop my fav is Top93.

Thanks for response. Our issue is how to determine which part of the cost falls under wear and tear ? When I brought up the issue to CASE, the coy simply shows a higher quote and indicate a larger portion to be wear and tear.

Is there anyway a workshop/mechanic can claim which part of the transmission gear is due to wear and tear, and which part is not ?

Assuming car is delivered in good condition, is it likely that transmission gear breaks down due to wear and tear after 5 months of low usage ?

Only engine and gear box u might have a case. As these items is consider a key factors in purchasing a used car. The rest is consider a wear and tear. I m sure u wont go after the used car dealer for a headlight halogen bulb, rite!! If u want details information u got to engage a professional lawyer or ask the case department for advise. If u buying a new car you will get the same answer too, no one would want to spell it out for you. Hope this helps.

I think the first red light appeared when STA check surfaced defects list and you agreed to buying the car with the defects (albeit to be rectified by the seller before taking over the car).

 

Since you're covered by lemon law for 6 months, why not return the car for a refund?

 

Did you get a good deal from the car in your opinion? If yes, treat your problems now as payback for your earlier cost savings. If no, then I wonder why you still went ahead to buy the car well knowing its defects list.

 

You're not buying a new car so transmission problems or whatever problems are not surprising. Did your car come with a brand new transmission? If it did and the transmission broke down within 5 months then I think you've got a case.

 

Personal experience: I bought a second hand car too and within 1 week the aircon compressor went kaput. Brought it back to the car dealer and negotiated a co-share on the payment. Case closed. Happily ever after. A day in a life of a second hand car.

Thanks for inputs. Whilst there are defects highlighted after the STA check, I was assured that defects are rectified and come with a 6 month warranty.

To blackmerc, I am only talking about gearbox. What he did was to list down all parts of the gearbox and claim that some parts are wear and tear whilst other parts are part of the warranty. Sounds like a sham ??
